Terms of Use

"No Spam" policy
MySponder.com ("The Company"), explicitly discourages Unsolicited Commercial Email (UCE), commonly known as 'Spam', and reserves the right to discontinue accounts which in its judgment are shown to have sent such email.

Anti-Spam Policy:

We will absolutely, positively not tolerate spam using our follow-up autoresponder services.

You may never spam via our service or send spam that in any way implicates our services. This includes mentioning a MySponder.com email address or URL in a bulk message or including these addresses on a bulk-advertised web page. You may not hide behind throwaway web pages or fax-response front ends.

If you spam, even if MySponder.com services are not directly involved in it (i.e. the spam leads the person to MySponder.com services), you will:

have your account terminated immediately without refund and notice
charged a $400.00 cleanup fee
be reported to your own ISP provider by us as a spammer, where they will presumably terminate your account as well.
you will be reported to authorities in your area

If you have been spammed, please notify abuse@MySponder.com

Undeliverable Mail
It is the autoresponder owners responsibility to ensure that imported email lists used are of sufficient quality for professional use. If autoresponders generate high volumes of 'bounces' back to the server from undeliverable email, The Company reserves the right to withdraw service.

Services
All services and products provided by the Company are done so "AS IS" and without warranty. The User assumes all risk and liability for any loss or damages resulting from or associated with the use of the Internet or software, services or materials provided by the Company.

The Company is not responsible and assumes absolutely no liability for any damages associated with the use of the Company's services.

The User agrees to hold the Company harmless from any damages resulting from a third party or third party software or services, viruses, or any other type of action, whether malicious or otherwise.
The Company explicitly denies any responsibility for the accuracy or quality of information obtained through its services or action take as a result of its advice, information or services.

Payment/Renewal of Services
The User agrees to be responsible for the payment for all services and products provided by the Company. Credit card purchases are subject to the terms and conditions set out by the credit card company.

Accounts paid for by credit card will be automatically renewed at the end of the agreed term at the current rate for the same term as before.

Failure to remit a payment (either by check or credit card) could result in the interruption of service.

In order to terminate an account, the User must notify the company via Email at least 7 days prior to the renewal date. Failure to do so will result in the account being charged for the following month of service at the rate set forth by the previous term.

Account Sharing Policy
Each account is for the use of one person/business. Your Mysponder Pro Version AutoResponder has the ability to create multiple autoresponders. As a user you shall not share your system. If you are found in noncompliance with this policy your account will be immediately terminated. You will not receive any refund and you will not have any further access to your account. You will also be bannned from our system in the future.

Right of refusal
The Company reserves the right to cancel or refuse service to anyone at any time without reason. In particular the Company does not knowingly accept to transmit 'adult' or pornographic material.

By checking the Terms of Service box on the sign up forms, the User agrees to the terms set forth above. The User also agrees that any other person they have authorized to use this account has been provided this information and is bound by this agreement as well. Use of account services by the User or one of their authorized representatives constitutes acceptance of this agreement and the Acceptable Use Policy. If paying by credit card, the User also agrees to the purchase terms set forth by their credit card company.
